1. Operator and contact

2. Scope and acceptance

These terms apply to use of the Fivamo website and purchases made through it. By placing an order, you confirm that your order information is accurate and that you are legally able to enter the purchase contract. Mandatory consumer protections always prevail over conflicting terms.

3. Product information and safe use

We aim to present product descriptions, photographs, specifications, compatibility information, package contents, and prices accurately. Screen colours and packaging may vary where this does not change essential product characteristics. Material substitutions will not be made without your agreement.

Automotive products and tools must be used only for their documented purpose and within verified ratings. Follow supplied instructions, warnings, vehicle or tool manufacturer guidance, load and pressure limits, and applicable safety requirements. A product described for a vehicle category is not compatible with every make, model, year, trim, or configuration unless expressly confirmed.

4. Prices and payment

Prices are shown in euros (EUR) and indicate applicable taxes as required. Shipping charges and the total payable amount are displayed before you submit the order. Payment is processed through the methods shown at checkout. An authorization or automated acknowledgement does not require us to accept an order affected by an obvious pricing error, suspected fraud, or unavailable stock; any captured payment for a rejected order will be returned.

5. Order acceptance and cancellation

The purchase contract is accepted when we confirm acceptance or dispatch. We may contact you if information is incomplete or an item becomes unavailable. You may request cancellation before dispatch by emailing us. After dispatch, eligible consumer orders may be cancelled through the statutory withdrawal process in the Return and Refund Policy.

6. Shipping

Orders are normally processed within 2 business days. Estimated delivery is within 8 days after dispatch. Standard shipping costs €4.97 per order where offered; exact destination availability and the charge are shown before payment. Timing is an estimate unless a specific date is expressly agreed. The Shipping Policy forms part of these terms.

Risk of loss or damage remains with Fivamo until you, or a person you designate other than the carrier, receive the goods, except where you independently commission a carrier not offered by Fivamo.

7. Withdrawal, returns, and refunds

Eligible consumers may withdraw from an online purchase within 14 days after delivery without giving a reason. The customer pays the direct return cost for a change-of-mind withdrawal. Fivamo bears the lawful cost of resolving goods that are defective, damaged on arrival, or incorrect. Full procedures are in the Return and Refund Policy.

8. Legal guarantee

Goods must conform to the contract. For new goods sold to consumers in Spain, Fivamo is responsible for lack of conformity that exists at delivery and becomes apparent within three years after delivery. Statutory remedies are provided free of charge as required by law. Any expressly documented commercial or manufacturer warranty is additional and does not reduce the legal guarantee.

9. Website use and intellectual property

Fivamo branding and original website text, graphics, and layouts may not be copied, republished, or commercially exploited without permission except where law permits. Users must not interfere with the website, attempt unauthorized access, introduce malicious code, or use the store for unlawful or fraudulent activity. Third-party trademarks remain the property of their respective owners and do not imply that Fivamo manufactures those products.

10. Privacy and third-party services

Personal data is handled according to the Privacy Policy and applicable data-protection law. We may rely on Shopify and other providers for hosting, checkout, fraud prevention, communication, fulfilment, analytics, or payment processing. Their role does not remove Fivamo's obligations to you.

11. Liability and mandatory rights

Nothing in these terms excludes or limits liability or consumer remedies where prohibited by law, including liability for defective products, fraud, wilful misconduct, or death or personal injury caused by negligence. You remain responsible for damage caused by use contrary to verified instructions or safety limits, to the extent permitted by law.

12. Governing law and disputes

These terms are governed by Spanish law, without depriving consumers resident elsewhere of mandatory protections provided by applicable law. Contact us first so we can try to resolve a complaint. Any court provision is subject to mandatory consumer-jurisdiction rules.

13. Changes and severability

We may update these terms for future use of the store. The version accepted when an order is placed continues to govern that order unless you agree otherwise or law requires a different result. If any term is found invalid or unenforceable, the remaining terms continue to apply.
